This Site is written under California law.

1. Who operates this site

PoeLand (the "Site") is operated by I Dreamt I Was An LLC ("we," "us," "the Site"), under authorization to operate an official/authorized fan community for the artist professionally known as Poe. By using this Site, you agree to these Terms of Use.

You must be at least 13 years old to use this Site (16 if you are in the EU/UK). If you are under 18, you confirm you have a parent or guardian's permission to use the Site, including any paid membership.

2. Trademarks, name, image, and likeness

"Poe," her name, image, likeness, voice, album titles, and associated marks are the property of Poe and/or her authorized representatives, used here under license/authorization. Nothing in these Terms grants you any right to use Poe's name, image, likeness, or any associated trademark for any purpose outside normal use of this Site (e.g., you may not use them to promote your own commercial products or imply endorsement).

Site content we create ourselves — the design, original written content, and compiled forum content — is owned by us. Users retain no ownership claim over the Site's own branding or design.

AI-generated and manipulated content. You may not create, post, or share AI-generated or otherwise digitally manipulated audio, video, or images depicting Poe (a "digital replica") without express authorization from Poe and/or her representatives, regardless of whether it's labeled as fan-made, parody, or otherwise. This is prohibited both under these Terms and under California's right-of-publicity statute, Cal. Civ. Code § 3344, which was amended by SB 683 to explicitly cover unauthorized digital replicas of a person's name, voice, or likeness, and permits injunctive relief as a remedy.

3. Fan-created content, products, and third-party sites

Fans and users may independently create their own content, websites, apps, artwork, merchandise, or other products inspired by or referencing Poe, her name, likeness, music, or story. Doing so — including sharing such content within this Site's community, or with Poe herself — does not imply, grant, or constitute any authorization, endorsement, license, sponsorship, or approval, whether from us or from Poe and/or her authorized representatives. Community engagement with, discussion of, or tolerance of fan-made content on this Site is not a form of approval.

Anyone creating such fan content remains solely responsible for it, including ensuring it doesn't infringe Poe's (or anyone else's) trademark, copyright, right of publicity, or other rights. We and Poe's representatives make no representation about, and bear no responsibility for, any third-party fan-created content, products, apps, or sites, regardless of whether they are discussed, linked, or shared on this Site. Only this Site itself operates under an actual authorization agreement; that status does not extend to any other fan project, however similar or well-intentioned.

4. Content you post (user-generated content license)

When you post, upload, or submit any content to the Site — text, images, audio, video, or otherwise — you represent that you own the content, or have the legal right to post it, and that it does not infringe anyone else's rights. By posting, you grant us a license to host, display, and distribute it as part of operating the Site. You may not post copyrighted music, video, or images you do not own or have permission to share. Full details govern in our Copyright & DMCA Policy, which is incorporated into these Terms by reference.

5. Ideas and suggestions you share are not owned by you

If you share an idea, suggestion, concept, or proposal with us or with Poe — for a song, artwork, merchandise, event, business venture, or anything else — you are not entitled to credit, compensation, or ownership over how it is used, even if something similar is later created. No contract to pay or credit you is formed by your sharing an idea, and we do not accept ideas on any expectation of payment. This is governed by California law under the framework established in Desny v. Wilder, 46 Cal.2d 715 (1956) and its progeny. Full details are in our Community Content & Idea Submission Policy, which is incorporated into these Terms by reference and which you agree to by using the Site.

6. Paid memberships and subscriptions

If the Site offers paid membership tiers, subscriptions, or exclusive content access, before you complete a purchase we will clearly and conspicuously disclose, next to the action you take to accept: 1. That the subscription automatically renews unless you cancel; 2. The length and terms of the renewal period; 3. The amount (or range) you will be charged and how often; 4. How to cancel; and 5. A direct link to the cancellation process.

We will obtain your affirmative consent to these terms — not a pre-checked box or assumed agreement — before completing your purchase. If you sign up online, you can cancel online, including via a "click to cancel" option that is at least as easy to use as the signup process. If a subscription's initial term is one year or longer and it automatically renews, we will send a renewal reminder between 15 and 45 days before the renewal date. Fees already charged are non-refundable except where required by law or stated otherwise for a specific offer. Payment processing is handled by a third-party payment processor; we do not store your full payment card details.

Merchandise is sold through poestuff.com, a separate store operated independently of this Site. Membership tiers on this Site may include perks usable at poestuff.com (e.g., discount codes or early access), but purchases made there are governed by poestuff.com's own terms and privacy policy, not this document.

7. Conduct rules

You agree not to post content that is unlawful, defamatory, harassing, obscene, or that violates another person's rights. You also agree not to: - Share another person's personal contact information, home address, or other identifying information without their consent ("doxxing"); - Post photos, videos, or recordings of other identifiable people who have not agreed to appear, or that are unrelated to the Site's community purpose; - Direct or induce other users to unverified external links, scams, or phishing attempts; or - Deliberately post or spread false or manipulated information, including manipulated images, audio, or video.

We may remove content or suspend/terminate accounts at our discretion for violations of these Terms. If your account is terminated for a violation while you hold a paid subscription, your subscription is cancelled and any fees already paid are forfeited (not refunded), except where required by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless: - I Dreamt I Was An LLC, operating as PoeLand and "RePOEzessed"; - Poe, and her agents and representatives; - and each of the foregoing's respective officers, directors, staff, employees, moderators, volunteers, and agents (collectively, the "Released Parties"),

from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your Submissions or other content you post; (c) your violation of these Terms; or (d) your violation of any third party's rights.

9. Disclaimer and limitation of liability

The Site is provided "as is" and "as available." Neither we nor any of the Released Parties defined in §8 guarantee the accuracy or reliability of user-posted content and are not liable for it. To the maximum extent permitted by law, the total liability of us and each Released Party to you for any claim related to the Site is limited to the amount you paid us, if any, in the 12 months before the claim arose. Nothing in this section limits liability where prohibited by California law.

10. Governing law, venue, and dispute resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in the county of our principal place of business in California, and you consent to that jurisdiction and venue.

11. General provisions

Severability. If any part of these Terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be limited or eliminated to the minimum extent necessary.

Entire agreement. These Terms, together with our Privacy Policy, Copyright & DMCA Policy, and Community Content & Idea Submission Policy (each incorporated by reference), are the entire agreement between you and us regarding the Site, superseding any prior agreements on this subject.

Assignment. We may assign these Terms (for example, if the Site is transferred to a new operator); you may not assign your account or these Terms without our consent.

You may leave anytime. You can delete your account at any time from your account settings. Content you've posted publicly may remain visible per the license in §4, even after account deletion, unless you request its removal separately.

12. Changes to these terms

We may update these Terms from time to time; continued use of the Site after changes take effect constitutes acceptance.
